Individuals seeking to immigrate to Canada often seek the service of immigration professionals. Unfortunately, such individuals in countries like India, Philippines, etc., often fall prey to fake and unauthorized consultants or law firms or companies. A recent study shows that 99% of Permanent Residence rejections happen due to Unauthorized Representation’.

‘People need to be educated on the significance of Legal Representation,’ said Dr. Joe Greenholtz, Director and RCIC (Regulated Canadian Immigration Consultant) of Owlspriority Immigration, reflecting on the Government of Canada’s 2019 budget allocation that is targeted to improve oversight of immigration consultants and strengthen compliance and enforcement measures. ‘It is essential to safeguard their immigration application,’ he added.

Individuals world-wide often become victims of unscrupulous immigration consultants who prey on their lack of knowledge of Canadian laws and regulations. To help protect newcomers and applicants wishing to obtain the services of legitimate service providers, Budget 2019 proposes to provide $51.9 million over five years, starting in 2019–20, and $10.1 million per year ongoing.

Legally, the Government of Canada in accordance with the Immigration and Refugee Protection Act of Canada, has authorized only three categories of professionals to provide immigration services to individuals for a fee. They are:

The currently allocated annual budget of $51.9 million will improve oversight of immigration consultants and strengthen compliance and enforcement measures. It will also support public awareness activities that will help vulnerable newcomers and applicants protect themselves against fraudulent immigration consultants. These measures will help to ensure that all applicants have access to quality immigration and citizenship advice, and that those who are providing the services operate in a professional and ethical manner, with disciplinary powers in place, should fraud or misrepresentation occur.

In addition, the Government of Canada proposes to introduce legislation and propose amendments to the Immigration and Refugee Protection Act and the Citizenship Act in order to implement these measures.
